These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors personalised products. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. USER CONTENT AND CONTENT RULES
Images and other material (including textual annotations to and comments on Images) uploaded, posted, contributed, distributed, communicated, transmitted or linked-to by a User on, through or in connection with SimplyGiftInk are treated as "User Content" for the purposes of these Terms
(Fair Use Act circumvents 2006 Digital Millennium Copyright Act"DMCS")(UK/EU Copyright Directive). Users must have the right to deal, and the right to aurthorise us to deal, with their User Content in the ways that they and we use it in connection with the Services or for other purposes referred to in these Terms.
You must not upload User Content, or otherwise deal with User Content through SimplyGiftInk, if you do not have the right to do so. Each User shall ensure that his/her User Content, and his/her and our use of it, does not:
* Infringe anyone's copyright (DMCA take down notice applicable); in particular, you must ensure that you either own the copyright in an Image that you upload to SimplyGiftInk or that you are fully licensed by the copyright owner to upload the Image and to make any subsequent use of it (such as by including the Image in a product or in email and other communications such as through our social media platforms);
* Infringe anyone's privacy or data protection rights; in particular, you must ensure you have the right to depict any person who appears in an Image that you upload to SimplyGiftInk and to aurthorize the subsequent use of it (such as by including a depiction of that person in a Product or in email and other communications such as through our social media platforms);
* Infringe any other rights, such as a trade mark, of any persons or entity or a duty owed to any person or entity, such as a duty of confidentiality;
* Contravene any applicable law (including, without limitation, any criminal law) or regulation;
* Include anything that is false, inaccurate, misleading, offensive, abusive, threatening or defamatory, or that might cause needless annoyance, inconvenience or distress to any person;
* Misrepresent the User's identity in any way or impersonate any person;
*Include any material containing personally identifying information about another person, such as their real name, address, phone number, or email address, except with the written approval of that person;
* Contain material which is obscene, indecent or offensive, which promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or that may incite hatred or violence against any person or group;
* Harass, upset, embarrass, alarm or annoy any person;
* Give the impression that it emanates from us, if this is not the case;
* Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website or on our social media platforms for promotional purposes.

RIGHT TO SUSPEND OR CANCEL USER ACCOUNT
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall [website owner], be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

RIGHTS TO CHANGE OR MODIFY TERMS
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

PROMOTIONAL EMAILS AND CONTENT
You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

PAYMENTS
Paypal via goods is the method we recommend you make payment by, as this offers protection for your purchase. We also use Stripe for card payments via the website which is a secure site. However we can offer bank transfer payments.
Cash, Cheques or postal orders are NOT accepted. Payment must be made prior to your goods being made, unless stated otherwise.
“SimplyGiftInk” must receive full payment for the price of the goods that you order before your order can be accepted, and the contract formed.
DELIVERY
Our items are all made to order (unless stated otherwise) and once payment has been made we will endeavour to ship your order out within 1-2 weeks.
This may be longer depending on the time of year or workload. To enquire about your order progress, please get in touch using the 'Contact Us' form.

All items are delivered using Royal Mail signed for, with proof of delivery. Should your order not arrive, please 'Contact Us' so we can arrange a replacement or refund.
RETURN POLICY
Under the consumer contract regulations, your right to cancel begins from the moment you place your order, up to 14 days after receiving your order. Your right to cancel is unconditional. We ensure that all items posted to our customers are of the highest standard, but if there is ever a need to return an item we do accept returns for a full refund. This policy does not apply for custom made/personalised items. All returns must be in a resealable condition, unopened, unused and in its original packaging to ensure a safe return. Please provide a senders address with your return and all items must be sent via Royal Mail signed for and proof of postage must be obtained. A refund or replacement will only be issued once the item has been received by us in the condition the sender received it.

If you wish to return an item, or your item is damaged/faulty, please 'Contact Us'
and we will endeavour to resolve the issue as quickly as possible.

Custom made items are exempt from the consumer contract regulations,
the only exception being is if they're faulty. So please be aware that this does NOT apply to anything that has been personalised as this cannot be sold on.

We cannot offer returns for sale items, items marked as being reduced for having a defect, damage or any other reason will be exempt from the returns policy.
VARIATIONS
Please note that colours/designs of items may appear differently from what photographs display, due to filters, lighting, and photo edits.
We do not offer refunds (partial or full) for this.
CUSTOMISED ORDERS
Please get in touch if you require a custom order that is not shown on our website. You can contact us 'here' or by sending us an Email to sales@simplygiftink.com with your ideas or own design. We will provide you with an estimated quotation for the customisation, and full payment must be made prior to work commencing.
PHOTO UPLOADER
We at SimplyGiftInk strive to to produce items of the highest quality for our customers, so please ensure that you upload a high quality image to be used on our products. SimplyGiftInk cannot be held responsible for low resolution or low quality images that have been submitted, as this will result in a poor finished product.
We will not refund any low resolution or low quality orders as we
are not held accountable for this.
